Partner visas are classified into two main types:

• Prospective Marriage visa for those planning to marry an Australian resident

Details of Partner Visa Subclasses

The partner visa includes both temporary and permanent stages. Initially, a temporary visa is issued, which may be converted to a permanent visa after fulfilling certain conditions related to the duration and genuineness of the relationship.

Fiancés of Australian citizens, permanent residents, and eligible New Zealand citizens can temporarily enter Australia under this category.

Being partnered with an Australian does not automatically qualify one for permanent residence. Applicants must successfully apply for and meet the criteria for a permanent visa.

Visa Application Based on Your Location

• Within Australia: Apply for Partner Temporary Visa (Subclass 820) and Permanent Visa (subclass 801). These visas allow you to stay with your partner in Australia, leading to permanent residency after two years if the relationship remains authentic.
• Outside Australia: Partner Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100): These visas enable you to join your partner in Australia. A genuine ongoing relationship of two years is required for permanent residency.

Prospective Marriage Visa (Subclass 300)

Intended for individuals planning to marry an Australian resident, this visa is a prerequisite before applying for a Partner visa to settle in Australia permanently.

Applicants must meet the following criteria:

• Sponsored by a fiancé, partner, or in some cases, a parent or guardian of the partner, who is an Australian citizen, permanent resident, or eligible New Zealand citizen.
• Meet all health and character checks.

Extended Eligibility for Partner Visa

This visa also caters to those whose previous visa was refused or cancelled. Specific criteria must be met for eligibility:
