Northwest Territories PNP Employer Driven Program

To gain eligibility under the Employer Driven stream, employers will have to adhere to the following conditions and requirements:

• They would need to have an industry association, or a business, or a First Nation, municipal, local, or Territorial Government, in the region.
• They should have been in a full-time operation mode since at least a year, before they participate under this stream.
• They should be at great terms with the Workers’ Safety and Compensation Commission as well as the Employment Standards office of the NWT.
• Their job offer to a foreign national should be a permanent and a full-time one, with at least 37.5 working hours per week, proposed to the applicant.
• The contract of employment they provide to the applicant should be in accordance to the accepted standards of employment in the region; it would also mean that this employment contract, should in no way, conflict with any collective bargaining agreements that might currently exist.
• A copy of a positive LMIA will have to be submitted, in case it is applicable; workers who have an open work permit, or have applied under the Skilled Worker stream, will not need such a report.
• If the employer is not submitting an LMIA, they will have to provide a proof in the form national and local advertising, along with a summary of ad results; these results should necessarily include every application form that the employer might have received in response to the ad they published, and give reasons as to why those applicants were rejected.
• The pay they offer to the foreign national, for the proposed job position, should be based upon the rate of pay they advertised, the current accepted rate of pay for the workforce, as well as the rate specified in the LMIA.
• They will have to strictly adhere to the LMIA agreement.

For the applicants to be considered eligible under this stream, these are the requirements they’ll need to fulfil:

• They should have a legal status in order to have a work permit, and also actually work, in case they are living in Canada.
• Their intention to settle down permanently in the NWT should be clearly demonstrated.
• In accordance to the job offered to them, they should have the right credentials and certification.
• If so applicable, they should get themselves a license or have a proper certification or fulfil registration requirements for the job position.
• They will have to submit either original or a true copy, in either English or French, of their as well as their dependants’ passport, and birth certificate, in addition to their own marriage certificate.
• They will have to show that they have enough funds to settle as well as establish both themselves and dependants they might have (the minimum being 10,000 CAD for the applicant, and 2000 CAD for every dependant). As proof, they will need to submit bank statements, either certified in their name, or a bank-issued letter, written in either French or English, further notarized.
• They will also be required to submit the test scores of either IELTS or CELPIP, for English language, and TEF for French; and the tests should have been taken no more than two years from the day they submit their application.

Sub-Categories

There are two sub-categories under this program:

• Critical Impact Worker Stream
• Skilled Worker Stream

Critical Impact Worker Stream

This stream was brought into existence, so that the employers of the NWT could address the shortages they were facing in the form of critical labour, as they couldn’t find permanent residents or citizens with enough skills and qualification to take up certain job positions. This specially designed stream targets individuals who can work in occupations with an NOC level C or D, and who have at least 6 months of prior experience working in the same job position, while being in compliance with the work permit issued to them as per their temporary foreign worker status.

In addition to the general requirements cited above, applicants must also take care of these conditions, in order to be eligible under this stream:

• They should have been working for the employer sponsoring them, for no less than a year prior to submitting their application; and the job they work on, should have an NOC level C or D.
• They should be holding a worker permit pertaining to their foreign worker status, and be in full compliance with it.
• The minimum score they attain should be CLB 4, in all four categories, namely reading, writing, listening, speaking, in either French, or English.

Skilled Worker Stream

This stream has been designed, so as to target foreign nationals who have the right skills and qualification to work at a position offered by an employer in the region, that falls under the NOC level 0, A, or B. It’s a stream that is driven by the employers in the region, and therefore, the eligible applicants would need to have a job offered and be sponsored by an employer in the NWT, in order for them to apply for a PR.

In addition to the general requirements cited above, applicants must also take care of these conditions, in order to be eligible under this stream:

• The job they work in, should have an NOC level 0, A, or B.
• They should have acquired whatever formal qualification or special training they would require, in order to take care of the responsibilities that come with this job position.
• Their work experience should be in accordance to that mentioned by their employer, as per the job advertisement they published, or the job description they gave out.
• They should be able to easily and clearly communicate in either French or English.
