Child Offshore Visa (Subclass 101)

This applies if the child is:

• Supported by a parent or the parent’s spouse
• Unmarried
• Under 18 years old, or:
• A full-time student aged between 18 and 25, or
• 18 or older and unable to work due to a disability, depending on the sponsoring parent for support

The child may also include their dependent children in the application.

Eligibility for Sponsoring a Child

• A parent who is an Australian citizen
• Someone holding an Australian permanent resident visa or is an eligible New Zealand citizen
• The spouse or de facto partner of the child’s parent

Additional sponsors can include:

• A step-parent not currently with the child’s parent but legally responsible for the child under 18 years old
• An adoptive parent who adopted the child before becoming an Australian citizen or obtaining a permanent resident visa or NZ citizenship

Location during application is flexible:

• You may be outside Australia when you apply if you have previously entered Australia
• You have an Australian permanent resident visa but haven’t yet moved to Australia

If you have adopted a child after becoming an Australian citizen or permanent resident, or an eligible NZ citizen, you can apply for an Adoption visa (subclass 102).

Child Custody Requirements

To be eligible for this visa for a child under 18, you must demonstrate one of the following:

• You have obtained the written consent from all individuals with legal custody of the child
• The child’s country of residence legally allows the child to be taken abroad
• The arrangement aligns with any child orders in Australia

Additional Basic Requirements

• The child must fulfill specific health requirements, which are typically valid for one year. This applies to all dependent family members included in your visa application, regardless of whether they are migrating.
• Any child over 16 years must satisfy character requirements. This includes providing a police certificate from every country they’ve lived in for 12 months or more within the past decade since turning 16. A police certificate is only needed if requested.
• The child must not have any outstanding debts to the Australian Government, or they must have arrangements in place to settle these debts.
• The child may be required to provide biometric information as part of the visa application process.
