Partner Visa Subclasses

Partner visas are classified into temporary and permanent subclasses. Initially, eligible partners are granted a temporary visa which may lead to a permanent visa either after a set period or sooner if the relationship is longstanding or involves children.

This migration category also facilitates the entry of fiancés of Australian citizens, permanent residents, and eligible New Zealand citizens.

While being the partner or fiancé of an Australian resident does not guarantee permanent residency, applicants must apply and qualify for a permanent visa based on legal criteria.

Visa Options Based on Location

• If residing in Australia: Eligible for Partner Temporary Visa (Subclass 820) and Permanent Visa (subclass 801). This visa allows you to live in Australia with your partner. A permanent visa may be granted after two years if the relationship continues to be genuine.
• If outside Australia: Partner Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100): This visa permits entry and stay in Australia with your partner. A continuous genuine relationship of two years can lead to permanent residency.

Prospective Marriage Visa (Subclass 300)

This visa is for those who intend to marry an Australian citizen, permanent resident or eligible New Zealand citizen before applying for a Partner visa to settle permanently in Australia.

General Eligibility

To apply for this visa, you must meet these criteria:

• Be sponsored by a fiancé, partner, or sometimes a parent or guardian of your partner, who must be an Australian or eligible New Zealand citizen.
• Fulfill health and character requirements.
• If you have dependents, they may apply with you if they meet specific criteria.

Additional Eligibility for Partner Visa in Australia

The partner visa is also available to those who had a previous visa refusal or cancellation. However, specific conditions apply, such as not having had a partner visa refused since your last entry into Australia.

Criteria for Partner Visa Eligibility Post-Refusal:

• No previous partner visa refusals post-entry into Australia.
• No visa cancellations on character grounds under section 501.
• Submission of a form 40SP Sponsorship for a partner to migrate to Australia signed by an eligible sponsor.
• Two statutory declarations from eligible Australians supporting the relationship, submitted within six weeks of the application.
